You should read carefully these terms and conditions before you use our online shopping facility. By accepting these terms and conditions, you also agree to be bound by the terms and conditions.

Terms of Use

This website is owned and operated by Hsin Ten Enterprise Pty Ltd ABN 090670965 (“HTE Australia”) and may contain information and material from HTE International Group Pty Ltd and other HTE branch offices. Your access to and use of the information, materials and services provided on this website is conditional upon your acceptance and compliance with the terms, conditions, notices and disclaimers contained on this website. Your use of the site mean you will accept these Terms. The words “we”, “us”, “our” and “HTE” mean HTE Australia Pty Ltd and the words “you” and “your” refer to user of website who may be distributors or customers.

Privacy Policy

We regard your privacy as very important. We collect and use personal information mainly for processing memberships, payments and orders, arrangement of delivery, and processing of commission and refund. We will use all reasonable precautions to protect the privacy of your information to satisfy legal requirements. However, if you provide us incomplete or inaccurate information, we may not be able to provide you with the products or services you are seeking.

Information for Registration Purpose

1. New member signing up If you wish to register as a Distributor you must complete the Agreement Form and pay the membership fee. The personal information you must provide includes your: first name; surname; postal address; delivery address; telephone number; sex; date of birth and your chosen sponsor (or, ‘upline’). If you do not provide this information we may not be able to process your application commission, membership kit and your website log-in password. You can also provide us with your Company Name and provide us an ABN number, or you can also declare it as a ‘hobby’ (only applicable to Australian Distributors). Please read the conditions in the Agreement Form.

2. HTE Distributors You are responsible for updating us any changes to your personal details and banking details. You are also responsible for checking your membership has been renewed (only applicable to Australian Distributors). For commission purposes you will also provide us with banking details. Distributors will receive a password to access secure areas of this website. Make sure you are in a private and secure area when logging on. When accessing the online shopping you will require a Distributor Number and an online shopping password.

 

YOU ARE RESPONSIBLE FOR MAINTAINING THE CONFIDENTIALITY OF YOUR PASSWORD(S) AND SHOULD NOT LET ANYONE KNOW WHAT IT IS. Please read the conditions in the Agreement Form and HTE Business Handbook.

Online Shopping Code of Conduct (applies to Distributors only)

1.       You agree for the Company to collect and store information relating to your activities as an HTE Distributor

2.       You give consent to the Company to give your contact details to your direct sponsor or ‘upline’ only.

3.       You give consent to the Company to give your contact details or information relating to your Distributor activities to the HTE International Group.

4.      You must ensure that the Distributor and any personnel engaged by him/her to conduct or assist in conducting his/her activities as a Distributor will, in the course of and after fulfilling his/her obligations hereunder:

 

4.1 personal information collected and held by them only for the purpose of seeking orders and selling the product of the Company; and take all reasonable measures to ensure that the personal information is protected against unauthorized access, use, modification and disclosure.

4.2 At the time of collecting personal information ensure that all persons from whom personal information is collected are aware of, and consent, to the purposes for which the information is to be used.

Security

We understand that internet security is of significance importance to you.

We guarantee reasonable precautions to protect your personal information and transaction to provide you with a safe and secure online shopping experience.

When you place orders your transactions are encrypted using Secure Sockets Layer (SSL), the industry standard in e-commerce transaction security. Encryption scrambles the information transmitted across the Internet, including your credit card number, name and address. SSL also verifies the identity of the server and confirms that the original message arrives safely at its destination.

When you enter secure areas of our online shopping you will see a padlock symbol in the right hand corner of the screen.

You can also be assured that your details are not stored on computers directly connected to the Internet and that personal information are encrypted using standard industry methods.

Membership Eligibility

Our services are available only to individuals who can form legally binding contracts under applicable law. This website is not intended for persons under the age of 18. If you are under 18, you should speak to your parents, your guardian, or a responsible adult and obtain their permission to use this site. Distributors who seek to use this site must be 16 years and over.

To be an eligible Distributor you need to be 16 years and over. For Australian Distributors annual membership is A$50 (includes GST). You need to renew your membership every year if you would like to continue receiving the membership benefits (only applies to Australian Distributors).

Pricing & Payment

Payment

We accept mail orders, fax orders and online orders. Please complete an Purchase Order Form and retain your order number for reference. We accept payment in the form of cheque, deposit, money order or credit card. Online payments require a credit card only; we accept Visa, or Mastercard. In this regard, you are responsible for providing a valid credit card number with available credit at the time of purchase. You represent and warrant that you have authority to use any such credit card.

If you are sending us do not have, nor wish to use, a credit card, you should speak with your referring Distributor who may register and place orders on your behalf and accept cash or a cheque. Please read the conditions on the Purchase Order Form.

Pricing

We have only one standard price list based on the Australian dollar for both Distributors and Non-Distributors. If you are an Australian Customer you are responsible for payment of the GST. However, if you are an Overseas Customer, the GST is excluded in the price. For Overseas Customers please be aware of any customs tax/VAT that apply to your order – this is not included in the price. This varies in each country according to their customs law. Please read the conditions of the Purchase Order Form and Price List. You can contact a Distributor or the Company for advice.

Availability

We sometimes experience greater demand for an item than expected or an unforeseen delay in the shipment of goods. In the event of a delay you will be advised at the time of order placement.

Product Guarantees

Our guarantee and warranties exclude defects caused by misuse or damage after receipt.

Product Warranty

We provide two year product warranty for the Sun Ancon Chi Machine. This is a free service and maintenance of a mechanical product which includes one-way freight only. For other products, we only offer 1 year warranty with the exception of E-Power Belt which we only offer 6 month warranty.

Two-week Money Back Guarantee

• If for any reason you are not completely satisfied with our products, you may return or exchange the product in original condition within 14 days of purchase from your independent HTE Distributor. We reserve the right to accept or reject a refund application.

• Refund excludes freight and handling charges.

Delivery

Local Delivery (within Australia)

For local deliveries we use Australia Post. Please check the delivery rates for your corresponding city/suburb. You will receive a pick-up notice from your local post office for collection. Delivery time on the east coast cities may take 1-2 working day. Other regional towns and west coast cities may take 6 working days. If you require next-day delivery we can arrange a courier on your behalf.

Product Pick-ups

Should you wish to pick your products up from our Sydney Office please note our opening hour: Monday to Friday, 9am to 5.30pm. We advise you to contact the office to let them know you are coming to place an order.

Overseas Delivery

For overseas deliveries we use UPS Express. Please check the UPS delivery rates for Asia-Pacific, Europe, the UK, South Africa and other countries. After placing your order, you or your customer will receive a tracking number. This will give you the status of your parcel. The total cost of your order does not include customs tax/VAT. This varies in each country according to their customs law. You can also contact the Company for advice.

Public Holidays

Our delivery service operates reliably and consistently throughout the year. Some public holidays do however require changes to schedules from time to time. You will be advised of any change in schedule well in advance.

Future Development

We reserve the right to alter any of our ongoing arrangements, in order to provide a better service for all customers. Consistent with our service philosophy, enhancements of our delivery service may be introduced in the future.

Information Disclaimer

Our name and logos are registered trade marks and many not be used without our written consent.

You agree that all the materials displayed on or available through this website, including without limitation any and all names, logos, data, information, graphics, underlying software, displayed on or available from this website are protected by copyright, trade mark and other intellectual property laws and are available for your personal use only.

You must not copy, modify, alter, download, publish, broadcast, distribute, sell or transfer any such materials unless such use is expressly permitted by us or by applicable copyright laws.

Other terms and conditions (applicable to Distributors only)

Please read our terms and conditions in the Agreement Form and the Business Handbook. Here the following key points:

1.1 The Distributor is an independent Distributor and nothing will be construed to establish between the Distributor and the Company any relationship of principal and agent or employer and employee;

1.2 The Distributor understands that he/she will not be covered by the Company for any personal costs such as annual leave, sick leave, long service leave, superannuation or Workers` Compensation;

1.3 The Distributor warrants that he/she is wholly responsible for withholding such amounts from his/her remuneration or the remuneration of his/her employees as are required by law for taxation purposes etc;

1.4 The Distributor will hold harmless the Company against all the claims and demands in the execution of this Agreement;

4.2 At any point in time, the Distributor can only have one Agreement with the Company;

4.3 This Agreement can be terminated by the Company in writing by giving 14 days notice. To be entitled to commissions on sales, Purchase Orders must be given to the Company within these fourteen days;

4.4 The Distributor will only use related Promotional Materials, Advertising Materials, Purchase Orders and Agreement documents approved and provided by the Company. Any Advertisement must have prior approval from the Company

and

4.5 Distributors are required to understand and comply with all the terms of this agreement as well as those contained in the Policies and Regulations document included in the Business Handbook.

4.6 The terms and conditions in this agreement are not final and the company reserves the right to make amendments or additions to, or supersede, from time to time, the terms and conditions which appear in the Newsletter and the Business Handbook.

4.7 This Agreement will be governed by the Laws of New South Wales, Australia.
